Short version: use Momentum responsibly, your habit data stays on your device, paid licenses are personal and non-transferable, and the app is provided as-is.
Agreement
By using Momentum (the site and app at this domain), you agree to these Terms of Service. If you do not agree, do not use the service. These terms are between you and Forgeware ("we", "us").
The service
Momentum is a local-first habit tracker. Your tasks and progress are stored in your browser unless you choose to export them. We may update, change, or discontinue features at any time. We try to keep the core experience stable, but we do not guarantee uninterrupted access.
Licenses and payment
Some features may require a paid license. Payments are processed by Stripe. Prices and what is included in a license are shown at checkout. A license key is for personal use unless we say otherwise. Do not share, resell, or publish keys. We may revoke a license if we reasonably believe it is being abused. Refunds: available within 48 hours if the license has not been activated. Contact us if you have a billing issue.
Acceptable use
Use Momentum lawfully. Do not: - Attempt to break, scrape, or overload the site or our systems - Reverse engineer or circumvent license checks - Use the service in a way that harms others or infringes their rights We may suspend or block access if you violate these rules.
Your data
You are responsible for your habit data on your device. Back it up if it matters to you (export is available in the app). Our Privacy Policy explains what we collect for payments, licenses, and analytics.
Disclaimers
Momentum is provided "as is" without warranties of any kind, to the fullest extent permitted by law. We do not promise that the app will meet your goals, be error-free, or never lose local data (browser storage can be cleared by you or your browser). This is a productivity tool, not medical or professional advice.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data or profits arising from your use of Momentum. Our total liability for any claim related to the service is limited to the amount you paid us for a license in the twelve months before the claim, or $0 if you have not paid us.
Changes and termination
We may update these terms. We will change the "Last updated" date when we do. Continued use after changes means you accept the new terms. You can stop using Momentum anytime. We may end or limit the service with reasonable notice when practical.
Governing law
These terms are governed by the laws of United States, without regard to conflict-of-law rules. Any dispute arising out of or relating to these terms or Momentum will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in New York, NY, or by video/phone if both parties agree. You and we waive any right to a jury trial or to participate in a class action. Judgment on the award may be entered in any court with jurisdiction solely to enforce the arbitration award.
